The information includes both clinical and non-clinical support content. USER RESPONSIBILITIES

You are responsible for all activity you conduct on the app. You will not use the app for purposes proscribed by CanFASD from time to time, including without limitation: illegal or inappropriate purposes; sending spam; perpetration of security breaches; hacking; privacy breaches; fraudulent activity; distribution of viruses or other harmful code; transmission, distribution or storage of any material protected by copyright, trade-mark, trade secret or other intellectual property right without proper authorization or rights, or material that is infringing, obscene, defamatory, fraudulent, untruthful, disrespectful, discriminatory, or abusive; any unauthorized access, alteration, theft, corruption or destruction of files, data, transmission facilities or equipment; or to interfere with any other person’s use and enjoyment of the app; recruiting members as participants in a research project or school assignment of any kind, identifying persons to interview for a media project of any kind, interviewing members for a publication, recruiting volunteers for any service or organization, or soliciting members for any other purpose.

INFRINGING CONTENT

If you believe that anything posted in this app offends your copyright or other intellectual property rights, is defamatory, or otherwise infringes your rights, you may email CanFASD at the email address at the bottom hereof. We will take actions we believe are appropriate in the circumstances.

LIMITATIONS

All promises made by CanFASD with respect to this app are contained in this agreement. No promises implied by law (whether described as warranties, conditions, representations, or otherwise, and whether relating to merchantability, fitness, non-infringement, or otherwise) apply.
You cannot collect any damages from CanFASD for any reason (whether under legal theories of contract, tort, negligence, strict liability, operation of law or otherwise) that are not direct damages or exceed the amount paid by you to CanFASD hereunder for any goods or services that the claim arises from.
CanFASD relies on these limitations when entering this agreement and setting its fees, if any. They are a fundamental and essential part of our arrangement, and apply even if this agreement has failed in its fundamental or essential purpose or been fundamentally breached.

GOVERNING LAW

This app is governed by the laws of the Province of Ontario excluding any conflicts of law provisions and excluding the United Nations Convention on Contracts for the International Sale of Goods. Any legal action against CanFASD shall take place in the courts of the Province of Ontario. The parties attorn to the non-exclusive jurisdiction of the courts of the Province of Ontario.

LINKS

Any third party sites that are linked to this app are not under CanFASD’s control. CanFASD is not responsible for anything on the linked sites, including without limitation any content, links to other sites, any changes to those sites, or any policies those sites may have. CanFASD provides links as a convenience only and such links do not imply any endorsement by CanFASD of those sites.

SALE DETAILS

CanFASD tries to provide accurate information in this app, but errors may occur. CanFASD reserves the right to change the goods and services available through the app and their prices without any notice or liability. CanFASD cannot guarantee goods or services advertised on the app will be available when ordered or thereafter. This is Canada Fetal Alcohol Spectrum Disorder Research Network’s (“CanFASD”) privacy policy. This document explains CanFASD’s policies for the collection, use and disclosure of personal information. CanFASD abides by applicable privacy legislation.

This information is used for the purpose of providing our services to our users and customers. If we ever wish to use your personal information for uses outside of those required to provide you with our products and services, we will obtain your explicit permission first.

WHO WE SHARE THIS INFORMATION WITH

CanFASD does not share personal information with any third parties except as disclosed in this policy. CanFASD may provide personal information to its consultants, subcontractors and professional advisers (which shall be bound by privacy obligations) to assist CanFASD’s uses disclosed herein.
If we ever wish to disclose personal information to third parties for that third party’s use, we will obtain your explicit permission first. In the alternative, we will advise that we are going to do so in terms of use relating to the app in question, or we will advise at the point of collection so that you may choose not to participate or provide that information.

ACCESSING INFORMATION

Individuals may review their personal information contained in CanFASD files by contacting the CanFASD privacy officer. If an individual believes that any of their personal information is inaccurate, we will make appropriate corrections.

CanFASD may amend this policy from time to time by posting an updated version on our website(s). If such amendments affect how CanFASD uses or discloses personal information already held by CanFASD in a material way, CanFASD will obtain consent.
